The plaintiff, a retired Navy Commander, sues to recover the portion of his retirement pay which was reduced as a result of a decision by the Comptroller General construing the provisions of 5 U.S.C. § 59a (1958), amending Section 212 of the Economy Act of 1932, 47 Stat. 406.
