Appeal by the plaintiff, Cosmas Yilias, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 22d day of March, 1904, upon the decision of the court rendered after a trial at the New York Special Term sustaining the defendant’s demurrer to the plaintiff’s complaint and dismissing the said complaint.

The complaint alleges that on or about the 31st day of December, 1903, McDougall Hawkes, as commissioner oí docks of the city of New York, by and with the consent of the commissioners of the sinking fund of the city of New York, made and executed an agreement in writing with the plaintiff whereby the said McDougall Hawkes, as such commissioner of docks of the city of New York, did lease, demise and to farm let unto the said plaintiff for the term of five years, commencing on the 1st day of January, 1904, a certain piece of property about twelve feet square upon what was known as…
