On February 24, 1993, this court issued an order granting defendant’s motion to vacate a notice of pendency. This opinion was to follow.
Plaintiff was the highest bidder at a foreclosure auction of 50 apartments in defendant’s cooperative building. For reasons this court previously found sufficient to deny a preliminary injunction to prevent sale to third parties of the stock attributable to these apartments, the defendant rejected plaintiffs high bid.1 On October 8, 1992, the preliminary injunction was denied.
