I.INTRODUCTION

Before the Court is a Motion for Summary Judgment filed by Defendant US Airways Group, Inc. seeking to dismiss a personal injury claim filed by Plaintiff Irene Bomanski, an airline passenger on board a US Airways flight operated by Defendant. 1 Plaintiff was struck in the head by another passenger’s luggage which fell out of an overhead storage compartment prior to the aircraft’s departure.
