Appeal from an order of the Family Court of Tompkins County (Barrett, J.), entered August 19, 1998, which dismissed petitioner’s application, in a proceeding pursuant to Family Court Act article 6, for modification of a prior custody order.

Petitioner and respondent, the biological parents of Tanya (born in 1994), no longer reside together. By order of Family Court dated May 22, 1997, petitioner was granted sole custody, after a hearing, premised upon her role as the child’s primary caretaker, respondent’s abuse of drugs and alcohol as well as his physical abuse of petitioner in…
