This is a proceeding pursuant to article 78 of the Civil Practice Act in which an order is sought annulling a determination of an “ alleged” Board of Appeals of the Incorporated Village of Freeport.

*162Section 175 of the Village Law provides that the board of trustees of a village may enact zoning ordinances and may appoint a board of appeals to determine or vary the application of such ordinances. Under section 179-b it is provided in part: 1 ‘ Such board of trustees shall provide for the appointment of a board of appeals consisting of three or five members, each to be appointed for three years.…
