Before the court is plaintiff Tony Schoffstall’s motion for partial summary judgment and defendant Nationwide Mutual Insurance Company’s cross-motion for summary judgment. Mr. Schoffstall claims that Nationwide engaged in the unauthorized practice of law by using a staff trial attorney to defend him. Mr. Schoffstall argues that this conduct constitutes bad faith as a matter of law. Nationwide counters that it did not engage in the unauthorized practice of law.
