I. INTRODUCTION

On March 2, 1994, Plaintiff/Counterclaim-Defendant Paul D. McClellan (“Plaintiff’) filed a Complaint for Tax Refund, seeking refund of $200, plus interest, costs and attorney fees for employment taxes 1 erroneously assessed and collected.
