On May 24,1972, Samuel Castro, defendant below and appellant herein, was found guilty of first degree murder by a three-judge panel, having previously waived his right to a jury trial. On June 14, 1973, appellant’s conviction was affirmed by this court.
Appellant filed a petition for postconviction relief on June 22, 1976, alleging he was denied effective assistance of counsel. Said petition was dismissed on July 21, 1976. The record indicates no appeal was taken from this ruling.
