The three defendants above named were indicted and tried jointly under a charge of arson, in burning the gin house of one James P. Johnson, and upon their trial they were all convicted and recommended to the mercy of the court. After the verdict was'rendered, the defendant, Rhodes, moved for a new trial upon the minutes of the court, which motion was refused, and the defendant, Rhodes, was sentenced to imprisonment in the State penitentiary at hard labor, for the term of twelve years.
