In the circuit court of Jackson county, on March 23, 1867, the appellant, Bostick, as plaintiff, brought suit against James Scruggs as defendant, on a promissory note made by said Scruggs on December 27, 1860, for the sum of $125.00, payable one day after date to the Nashville and Chattanooga Railroad Company. Scruggs died, and the suit was revived in the names of the appellees, as his executors. After said note became due, the said railroad company, on December 16, 1861, transferred the same to one Halsey, who afterwards transferred it to the plaintiff, said Bostick. The defendants in the…
