In this action, charging common-law negligence, the trial court set aside the verdict in favor of the plaintiff, and dismissed the complaint. The plaintiff appeals from the judgment entered upon that determination.
It is not disputed that the plaintiff, Uly L. Townes, an independent contractor, started his own business of simonizing, polishing and washing cars about four months before the accident, in a five-story building occupied by the defendant, an automobile agency.
