On May 9, 1907, Williamson C. Hoover, while employed as a mule driver in the coal mine of defendant in error and driving a mule hauling two loaded coal cars along the eleventh west entry off the main south hauling way, fell in front of the first car and the front wheels ran over him and he therefrom received injuries which resulted in his death. Plaintiff in error was appointed administrator of the estate of said deceased and brought this suit against defendant in error to recover damages for the loss to the next of kin of said deceased occasioned by his death.
