MUNGER, District Judge.

This is an action to recover for an alleged injury to plaintiff while a passenger upon the defendant’s road. The petition alleges that the defendant is a corporation organized and existing under and by virtue of the laws of the state of Utah; that it was and is operating a line of railroad from Council Bluffs, Iowa, to and through Fremont, Neb. The petition further alleges that plaintiff was a passenger, and as such sustained certain injuries by reason of the negligence of the defendant at Council Bluffs, Iowa, on the 23d day of October, 1900, and for her damage by…
