I. INTRODUCTION

This appeal arises out of an action for recovery on an insurance policy. Appellee, Annette Bailey, sued appellant, Farmers Union Co-operative Insurance Company of Nebraska (Farmers Union), on two theories. In contract, Bailey sought recovery of the proceeds allegedly due under her homeowner’s policy following the collapse of her home. In tort, Bailey claimed damages for Farmers Union’s alleged bad faith in refusing to pay the claim resulting from the destruction of. the home.
