Rakower, J.), entered June 20, 2007, which denied plaintiffs motion for summary judgment seeking a declaration of the parties’ rights and obligations as to the payment of real estate taxes under their lease and to dismiss defendants’ counterclaims, unanimously reversed, on the law, without costs, the motion granted to issue a declaration that the lease requires defendant City of New York to pay real estate taxes on the entire block and lot and to remit payment directly to the City Department of Finance and defendants’ counterclaims otherwise…
