This proceeding was brought in the Civil and Criminal Court of Charleston by respondent, as landlord, to eject appellant, a tenant, for the non-payment of rent. The case was tried in September, 1945. At the close of the testimony, both appellant and respondent moved for a directed verdict. Respondent’s motion was granted “on the ground that it was admitted that the rent had not been paid”, and a writ of ejectment was issued.
