The damages recovered in this action were for the breach of the conditions of a joint and several bond executed by the defendant, Matthew Baird, together with the Sargent Granite Company, to the plaintiff, in the 'penal sum of 16,000. The condition of the bond was that the Sargent Granite Company should well and truly perform the stipulations and agreements in a contract made by it with the plaintiff to furnish all the granite for the erection of the Armory Building on Fourth avenue, in this city, cat, fitted, and ready to set, and deliver the same on a certain dock in New York City.
