ELY, Circuit Judge:

Jones appeals from a judgment of the District Court dismissing a complaint alleging that certain of Jones’ civil rights, conferred by the First and Fourteenth Amendments of the Constitution, were violated. 42 U.S.C. § 1988.

In November of 1965, Jones stationed himself near the Student Union building on the University of Arizona campus, at Tucson, donned a sandwich board sign which read “Help Stop Viet Nam war now. For Peace and Freedom,” and began to distribute handbills, critical of the Viet Nam engagement, to those passers-by who would accept them. He was observed by two…
