This was an action in trespass brought by Joseph G. Woodring jointly against the City of Easton, Metropolitan Edison Company and Mclnerney and McNeal, Inc., under the provisions of the Act of June 29, 1923, P. L. 981. At the trial of the case, at the conclusion of the testimony ex parte plaintiff, 'the court entered a non-suit as to the City of Easton. The case then proceeded against the remaining defendants, to-wit: Metropolitan Edison Company, and Mclnemey and McNeal, Inc.
