The defendant was arraigned in the third district court upon an indictment for embezzlement, the charging part of which is as follows: “The said Alexander S. Hill, on the eighth day of March, A. D. 1883, at the county of Salt Lake, in said territory of Utah, having been intrusted as bailee by one Lucy J.
