Sam Ellison, plaintiff in error, defendant in the trial court, was convicted of having illegal possession of 45 gallons of whisky. By verdict of a jury, his punishment was fixed at imprisonment in the county jail for a period of 30 days and to pay a fine of $200.

A part of the information states that—. “He (the said Sam Ellison) did then and there willfully and unlawfully have in his possession certain intoxicating liquor, to-wit, 45 gallons of whisky, with the willful and unlawful intent then and there to sell, barter, give away, and otherwise dispose of; contrary to the form of…
