DUNCAN, District Judge.

The question before us arises tangentially out of a diversity action filed by plaintiff-appellant National Polymer Products, Inc. against defendant-appellee Borg-Warner Corporation for damages arising out of the sale of a product supplied by Borg-Warner to National Polymer. The case was tried to a jury, resulting in a verdict for the plaintiff. The trial court later set aside the verdict and ordered a retrial. The merits of the plaintiff’s case and the Court’s new trial ruling are not at issue on this appeal. We are concerned here with the district Court’s enforcement…
