PHILLIPS, Circuit Judge.

On August 29, 1941, Robert C. Storri.e, Jr.,1 as Administrator of the estate of R. C. Storrie, deceased, filed an involuntary petition in bankruptcy seeking to have the Storrie Coal Company2 adjudged a bankrupt.

The act of bankruptcy alleged was that the Coal Company, while insolvent, between the 17th day of July, 1941, and the 31st day of July, 1941, suffered or permitted The McAlester Fuel Company3 to obtain a lien upon property of the Coal Company through judicial proceedings by the levy of an execution.
