This is the third appearance before this court of this action for damages for personal injuries. On the first appearance, on appeal from the trial court’s denial of plaintiff’s motion for new trial following a jury verdict for defendant, it was held that the evidence demanded a verdict against the defendant Dennard and that the trial court erred in overruling plaintiff’s motion for new trial on the general grounds.
