This is a motion for a new trial, made, on behalf-of the defendant, on the ground of newly-discovered evidence, under the provisions of subdivision 1 of section 465 of the Code of Criminal Procedure.

The application discloses that on the 23d day of May, 1894, the grand jury of Rensselaer county presented an indictment against the defendant, charging him with the crime of murder in the first degree, in killing one Robert Ross, dnd that on the 28 th day of May the defendant was arraigned before á Court of Oyer and Terminer in that county and thereafter, on the 29th day of that.month, entered a…
