Defendant was convicted of the crime of involuntary manslaughter, and he appeals.

The death of the deceased, George Goddard, was caused by a blow struck by the defendant during an altercation in the Del Rio Cafe, located on West Second South Street, Salt Lake City, Utah. The entrance to this cafe is on the north and the floor plan of the cafe is such that there was a short counter in the front. To the south of the counter was a dining room that had three rows of booths running north and south.
