— The town of Angola sued William and George R. Wickwire to recover a sum of money it had been compelled to pay one Swift for damages for an injury he received on account of a defect in the sidewalk in front of the defendants’ business lot in said town.

The complaint is in three paragraphs, the first of which charges, in substance, that the defendants owned a lot in said town abutting upon one of the public streets, and upon which was a business building; that they wrongfully, and without the consent of said town, made and maintained an excavation in the sidewalk in front of said building, to…
