Massachusetts District Court, Appellate Division

Decided February 4, 1953No. 4616Published

1Opinion of the CourtCavan, J.

This is an action of contract, on an account annexed, for labor and materials fur-nished to the amount of $1,146.04.

The defendant has paid $1,000.00, and the plaintiff seeks to recover the balance, $146.04. The answer is a general denial.

There was evidence that the plaintiff, a con-tractor, did carpentry work and furnished ma-terials for the repair of the defendant’s real estate in Chelsea; that, upon completion of the work, the defendant received a statement from the plain-tiff of charges for labor and materials furnished, totaling $1,146.04, and that said charges were fair and reasonable.
