Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Washington County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, an inmate at Great Meadow Correctional Facility in Washington County, was charged in a misbehavior report with three separate violations of prison rules (100.11 [assault on staff], 104.10 [violence, rioting] and 106.10 [refusing a direct order]) (see, 7 NYCRR 270.2). It appears that…
