(dissenting). My views upon the question of the construction of the contract here involved are fully stated in the majority opinion on former appeal (Smith Sons Lumber Go. v. Steiner, Crum & Weil, 204 Ala. 306, 85 South. 758), and need no restatement here. I adhere to those views, and therefore respectfully dissent.
