Stall-man, J.), entered April 5, 2005, which, inter alia, denied petitioner’s motion for an extension of time to serve an order to show cause executed by the court on February 16, 2005, unanimously reversed, on the law and the facts, without costs, the motion granted, petitioner granted a one-day extension, nunc pro tunc, to serve the order to show cause and service deemed complete as of February 18, 2005, and the matter remanded to Supreme Court for consideration of petitioner’s application for leave to serve a late notice of claim.
