Beversing.
Middlesboro is a city of the third class and operates under the commission form of government. Appellee^ Eobt. B. Gribson, was elected to tbe office of chief of police of the city on February 22,1926, and held the office until January 9, 1928, when the board of commissioners elected at the November election, 1927, adopted a resolution removing him from office and appointing in his stead the appellant, Chas. Minton. The mayor of the city refused to recognize the appointment of Minton as valid and continued to recognize appellee as chief of police.…
