The defendant is charged in a 13-count indictment with four felonies and nine misdemeanors, only one of which is a specified crime in the judicial diversion program as codified in CPL article 216. The charged felonies are operating a motor vehicle while impaired by the use of drugs, operating a motor vehicle while impaired by the use of alcohol or drugs, aggravated unlicensed operation of a motor vehicle in the first degree, and criminal possession of a controlled substance in the fifth degree.
