TERRELL, J.:
October 27, 1947, the Florida Industrial Commission, hereinafter referred to as the Commission, adopted a resolution setting up what it elected to call a retirement policy in which all its employees are retired at the age of 65, with the condition that on appropriate showing the Commission in its “absolute discretion” may continue any employee in service from year to year but in no case shall such employment be continued after the age of 70.
