Suit was instituted by appellee in the forty-eighth district court of Tarrant county, May 11, 1914, against appellant for $50,000 damages, alleged to have been sustained by plaintiff while in the employment of defendant as a switchman. The accident occurred on November 17, 1913, at Eagle Ford, Tex., and was caused by a passenger train, on which plaintiff was working, running into an open switch, thereby overturning the train. The plaintiff was caught under the engine and badly scalded, especially as to his right leg, and his right hand was so badly mangled that he lost a portion of the palm…
