This is an action of tort. In the first count of the declaration Alfhild C. Rossley, hereinafter called the plaintiff, seeks to recover damages for personal injuries sustained by her while a business invitee in the store occupied and controlled by the defendant. In the second count her husband, Harold B., seeks to recover consequential damages. The accident happened on November 22, 1955, at about 2:30 p.m. in the store numbered 474 Main Street, Worcester.
