OPINION

O’BRIEN, Judge.

The petitioner, Willie Robert Weatherly, has appealed from a judgment of the Davidson Criminal Court dismissing his petition for a writ of habeas corpus without an evidentiary hearing.

On February 25, 1981 and on April 29, 1981 defendant was convicted of separate offenses in the Sullivan County Criminal Court. He was ordered imprisoned for not less than three (3) years nor more than four (4) years for auto burglary and not less than three (3) years nor more than six (6) years for third degree burglary for a combined total sentence of not less than six (6) years nor more…
