This action was brought to secure a decree declaring a real-estate contract to have been rescinded and awarding judgment for the amount of the initial payment of purchase price. After a trial before the court, a judgment was entered dismissing the action.

The appellant desired to purchase property which he might improve and resell. His father and brothers were carpenters, idle at the time because of a strike.
