GARRISON, Judge.

The Director of Revenue (Director) appeals from the circuit court’s judgment reinstating the driving privileges of Jason F. Roach (Petitioner) following a trial de novo. We reverse and remand with directions.

Officer Foust of the Sikeston Department of Public Safety was on routine patrol at approximately 3:00 A.M. on November 25, 1995 when he noticed two cars in the parking lot of a church with their lights on and engines running.
