On March 20, 1911, the claimant General Construction Company entered into a contract with the commissioner of highways, under chapter 30 of the Laws of 1909, as amended, for the improvement of the Hollowville-Craryville County Highway No. 763 in Columbia county. On April 13, 1911, the General Construction Company duly assigned to the claimant Vincent Aderente all sums due or to become due to it under the contract, empowering Aderente to collect them, and to sue in its name. Subsequently, Aderente entered upon performance of the contract, and all the work done under it has been done by him.…
