(concurring) : In the case of State ex rel. Richards Moore et al., 152 S. C., 455, 150 S. E., 269, the Supreme Court had before it for determination questions pertaining to the constitutionality of Act No. 297 of the General Assembly of the year 1929, commonly referred to as “The State Highway Bond Act” (36 Stats., page 670). The late Chief Justice, Honorable R. C. Watts, Mr. Justice Cothran, and I were of the opinion that the Act was in conflict with the Constitution of the State.
