Defendant in error filed his bill to foreclose a mortgage, executed by plaintiffs in error. A demurrer to the bill was filed by plaintiffs in error. On October 4,1897, while the suit was pending upon bill and demurrer, a notice was left at the office of the solicitor of plaintiffs in error, to the effect that on the following day, viz., October 5,1897, or as soon thereafter as counsél could be heard, -the solicitor for defendant in error would call up the demurrer for disposal.
