MEMORANDUM OPINION

I. Introduction

Bernard Katz as liquidating supervisor (the “Liquidating Supervisor”) is before the court on the Motion for Estimation of Thomas-Related Claims Pursuant to Provision 7.4 of the Plan that he filed in the above-styled case on January 29, 2004. The court has sustained the motion and established a procedure for the estimation of the claims. The parties have asked the court to resolve two legal issues early in the process to narrow the scope of the questions to be decided in estimating the claims. Those issues are (1) whether…
