Plaintiff, John T. Downey, appeals a June 3, 2002 order of the Appeals Council of the Social Security Administration refusing to review the October 24, 2001 decision of an Administrative Law Judge (ALJ) denying Plaintiffs claim for benefits. Plaintiff moves for an order pursuant to 42 U.S.C. § 405(g), reversing the determination of the Commissioner of Social Security (“Defendant”) and remanding Plaintiffs claim solely for the calculation of benefits, or, in the alternative, remanding the Plaintiffs claim for a new hearing and decision.…
