Reversing.
On September 1, 1914, the appellee (plaintiff below), who is a man 32 years of age, had his right leg amputated just above the knee, and some days thereafter it was again amputated about four inches below the hip, which last operation was successful, and the plaintiff was permitted to leave the hospital about October 10. He filed this suit against appellant (defendant below) seeking to recover from it the sum of $25,000.00 damages upon the ground that he was injured in his right leg while working as a miner in its coal mine about two o’clock p. m.…
