This is a submission on an agreed statement of facts. The controversy is between A. R. Cunha and David Kalauokalani, clerk of the City and County of Honolulu. The question involved is whether Cunha- is entitled to have his name placed on the official ballot at the general election to be held on November 6, as a candidate for the office of supervisor of the City and County of Honolulu.
