By rule or standing order of the court, in pursuance of the *339Act of May 13, 1887, P. L. 108, the license court of Clinton county was fixed for the fourth Monday of November in each and every year. In 1906 the fourth Monday in November was the twenty-sixth day of the month. J. A. Crawford, appellee, filed his petition for a hotel license on November 7, 1906, only nineteen days before the sitting of the license court.
