The plaintiff, Joseph Paskarnis, Jr., was discharged from his job as fire chief of the Darien-Woodridge Fire Protection District (defendant). The plaintiff filed a two-count second amended complaint in the circuit court of Du Page County, alleging the tort of retaliatory discharge in count II. The defendants filed a motion to dismiss count II for failure to state a cause of action pursuant to section 2 — 615 of the Code of Civil Procedure. (735 ILCS 5/2 — 615 (West 1992).)
