JACKSON, Justice.

J. H. Pettit and Elizabeth Amanda Pettit were husband and wife, and at the time of her death on April 10, 1910, they had accumulated a community estate comprised of three sections of land, Nos. 8, 10, and 12, in block P. in Lubbock county, Tex., containing I,920 acres, and certain personal property.

Against the land there were community debts of 97½ cents per acre due the state and $5,000, the payment of which was secured by a deed of trust. Mrs. Pettit died intestate and no administration was ever had on her estate. There were nine children born to her and her husband, all of…
